Today's Buyer And Seller Leads Merit More Than 60-Day Kick-Out Clause
The transitioning market has been difficult for many real estate agents, add the annual third-quarter slowing, and it’s time to rethink how you approach post-boom home buyer and seller leads. The first item you need to re-invent is how you handle and market to leads that you used to give sixty days to and then optioned your kick-out clause, much like home-sale kick-out contingencies in real estate contracts. Consumers today are looking for an agent that has more on their mind than the clients commission check in the bank in the next couple of months. An experienced eighteen-year agent recently came to me for consultation. After the headiness of the hot sellers market, she bottomed out, business-wise. She didn’t even know what hit her, the last four years she pumped out closed transactions. In 2006,she has closed next to nothing through the first half of the year. This story is the marketing story of the year being repeated with many more experienced and new agents, in many markets. What happened? Number one is that many agents in the gravy days didn’t have time to market, didn’t think they had to market, or didn’t want to market th

Returns, How To Handle Them, And Save The Sale
When someone returns something (that you will refund on)....The first thing I tell them is that I will refund their money. That sets their mind at ease, so I can find out what the problem is. Starting off by saying “We don’t give refunds” is the beginning of an argument. I’ve had people bring back machines the next day simply because the vacuum cleaner bag was way too full, and the vacuum stopped picking up dirt. Had I started off saying “We don’t give refunds”, we never would have found out that the problem is very simple to solve. Solving problems is always more profitable than arguing. Also, try to let the customer leave happy. Every person is either the Hero or Victim of the story. Let them be the Hero. If you argue to prove a point, they leave unhappy. The only way for them to get even with you, is to tell anyone who will listen, that you are evil, and they were your victim. A hundred of those kind of stories about you can sink your business. I’ve seen it happen. Ads won’t work then, nothing will.Assure the customer that they can get a refund, try to solve the problem, and make the customer happy. That's what success

    Contract Laws
Contract laws are very important in modern times, with more and more people and firms entering into agreements with each other for various purposes. Contract law, to put in simple words, is a law that governs contracts. Contract law can assume many forms. It could be for instance something written on a piece of paper or it could be a verbal agreement, if it were to satisfy the statute of frauds.Generally speaking, a contract is an agreement between two or more people, which creates an obligation to do or not do something. The agreement comes along with a list of rights and duties, bounding on the parties involved. In case the agreement has to be broken, there are provisions in the law for remedies.Contract laws cover the legal aspects and implications arising out of the law. Contract laws determine whether or not a contract is legally competent. They also deal with other related things like whether there were fraudulent measures involved or with procedures which define how a contract is terminated.Contract laws are deemed invalid if, for instance, they go against public policy. Usually in most of the countries, people who

Good Legal Writing - A Short Primer for Lawyers
Last week I received an email from an associate with an attachment – a one page letter to adverse counsel. The email was one sentence: “Is this okay to send?” Here are the first two lines of the attached letter, word for word, the punctuation as it was in the letter:This letter hereby rejects your notice of EBT dated March 23, 2007 of the father of my client scheduled for August 23, 2007. I admit I had a good laugh when I opened it considering we spoke just last week and you told me you were looking to get me a date for your clients deposition that you had previously requested to be adjourned.Yes, that was actually written by a lawyer. I still can’t read it without cringing. Unfortunately, the same can be said about much of what we write. It doesn’t have to be that way. In fact, as lawyers, language is perhaps our most important tool. The clearer, more concisely we write the better off we’ll be. Here then, are a few tips gleaned from a few years attempting to do just that:• Know your audience. For lawyers this means really thinking about who is going to be reading your writing. If you’re making or opposing a mot

Customer Psychology Tips - Getting Your Customers To Commit To The Sale
So, earlier this week, I watched the movie "An Inconvenient Truth".That's the one where Al Gore travels the world giving his presentation on global warming. Now, politics aside, the movie gave me a hands-on lesson about the power of commitment, and in this article, I’m going to show you how you can use this power to get your customers to commit to the sale...You've probably heard of the commitment and consistency principle. Dr. Robert Cialdini explores it in his classic book, "Influence". Simply put, the principle says that when we take a stand on something, we're under tremendous psychological pressure to behave in a manner consistent with that stand. So what does that have to do with Al Gore, you ask?Well, I've never been very environmentally conscious. I mean, I used to watch that "Captain Planet" cartoon back when I was a kid, but I digress...After seeing the movie though, I found myself thinking "Wow, I wonder what I can do to help solve the problem."More importantly, my roomate provided everyone in the house with re-usable shopping bags so that we didn't have to use plastic ones all the time

    Taxes on Personal Injury Settlements
Personal injury settlements are a way for you to recover lost funds, limit the suffering caused by your injury, and secure the right kind of treatment for your injuries. Most insurance providers will offer personal injury settlements immediately even if you are still getting treatment from the hospital. A personal injury settlement is actually a way out for insurance providers, but it can benefit you as well. For one, if you accept a personal injury settlement, this will mean that you want have to go to court. Cases like this often take a long time to litigate before you can achieve the final resolution.Say you were in an accident and you sustained injuries to your face, knees, and back. You filed a personal injury complaint and fortunately, you received a settlement from your lawsuit. The settlement totaled about $50,000 but you will not get that in full. You will have to pay your lawyer his fees and your health insurance will be reimbursed for as much as $2,000. So you ask, do you still have to pay income taxes on your personal injury settlement? The answer is yes.The complaint you filed that resulted to a settlement agreement

One of our properties, a 5.5 million dollar one, had over a hundred professionally taken pictures on several web pages. Internet and MLS submissions are done as soon as the property is listed for sale with us and while you are getting the work done in the real world. This puts your property in it's best appearance while you are doing the finishing touches.

One of our sellers was not quite certain that painting the entire inside of the home and putting in all new carpeting was really important to sell their home. We did the work first on a picture-fixing program on one of our computers and they agreed with us and got the work done right away. They saw how less than $20,000 in painting and carpeting raised the value of their home at least $50,000. The did a magnificent job and it was done in a couple of weeks AFTER we had all the work done on our site here.

Another seller had an motel-apartment complex that had a fire and was burned very badly, it was almost a complete loss. With picture fixing software and a lot of time, we repaired the burned off roof, rebuilt the walls, put in new windows and doors, new sidewalks, new grass and parking and made all the improvements, on our web site, before he could repair the damage. The pictures were done several months before the work was done. Before the motel was even complete in the real world, the seller decided he liked the looks of the property on our web site so much he decided to keep the property and raise the rents to get and keep a better class of tenant. Oh well, we lost the sale but our community was improved greatly.

We place digital classified ads in all manner of periodicals, to direct people to your property on our Web sites; these ads are placed in dozens of Real Estate On Line publications. Many people search the Internet for property in special locations and are interested in recreation, lodging and real estate in our area. We have numerous ways for them to find us in Web Searches in addition to the above: we have paid to have our sites listed under tens of thousands of different search criteria with the major search engines. This is done to help buyers find us and to help sellers get more exposure. Most web sites are only listed in the search engines under one, two or ten key words and search strings, instead of the nearly 900,000 terms and search criteria that we use!

Web based marketing is responsible for well over nine tenths of the calls we get each day and is the MOST EFFECTIVE WAY TO PROMOTE A PROPERTY. For properties over $300,000 about 98% of the e-mail and calls are from our various Internet marketing activities. We also send out periodic newsletters and entice those thinking of purchasing Real Estate in the future.

As other Realtors in the area develop more professional and workable Web marketing sites; we allow them to place your property on their sites also for even more exposure. Professional real estate advisors tell us to expect over 80% of ALL real estate business to come from Internet marketing within the next two years. Our experience is already well beyond that figure!

Print media advertising is certainly not dead, but far less effective than it was a few years ago. We use it a lot. We advertise extensively in the local publications. Th
